Former Cuomo Aide and Four Others Killed in Crash on Long Island Expressway

What are my rights if my loved one is killed in a car accident?

A horrendous multi-car accident on the Long Island Expressway recently killed five people.  The three car wreck happened when one of the vehicles, carrying a young boy who was celebrating his birthday, crossed the grassy median and slammed into two oncoming cars.  Police are investigating whether the driver of this vehicle was speeding at the time he lost control.  Victims of the crash include a 29-year-old former aide to Governor Cuomo, who was about to marry his high school sweetheart.  Several others were seriously injured in the crash.   Family members and the local community is left mourning the loss of these valued lives too soon.

Wrongful Death Actions in New York

Losing your loved one in a car accident is a tragedy of immense proportions.  The untimely death of your family member may leave you emotionally and financially devastated.  While a wrongful death lawsuit can never bring back the person you love, it can help you to obtain the financial compensation you deserve for your sudden loss.

A wrongful death action in New York arises when a person is killed as the result of negligence on the part of another person or company.  Negligent drivers that cause a fatal accident can be liable in a personal injury lawsuit.  In New York, a wrongful death claim must be filed by the personal representative of the deceased person’s estate.  Family members do not have an automatic right to bring this action unless they are appointed as the personal representative.

In a wrongful death action, the personal representative can seek damages for the losses suffered by the deceased person’s beneficiaries or heirs.  Potential damages awarded in a wrongful death lawsuit include:

  • Funeral and burial expenses
  • Medical expenses incurred before the decedent’s death
  • Lost wages and benefits
  • Loss of support and services
  • Lost inheritance
  • Conscious pain and suffering experienced by the decedent
