What are the top personal injury causes in New York?

Personal injury attorneys deal with a wide variety of injuries and causes. We handle cases involving a broad range of injuries, from broken bones to traumatic brain injuries and death, from many different causes. People always ask us what the most common causes are, so we thought we’d break down the numbers for you.

Slips, Trips and Falls

By far the most common accidents we see involve slips, trips and falls. Between 2012 and 2014, over 423,000 New Yorkers visited the emergency department for injuries arising from a slip, trip or fall. Why are these injuries occurring?

  • Icy or snowy sidewalks and stairs
  • Freshly washed floors
  • Slippery floors due to paint, wax or oily surfaces
  • Cracked or uneven sidewalks
  • Dangerous construction sites

These types of injuries usually arise in the context of premises liability. Usually recovery for premises liability requires some sort of negligence on the part of the property owner. For example, if the owner or manager of a building with an exterior stairwell fails to properly deal with icy stairs, they can be held liable for any injuries resulting from people traversing that stairwell.

Struck By or Against Something

After slips, trips and falls, the next major emergency room contingent involves people struck by or against objects. Over 182,000 New Yorkers founds themselves injured by flying objects or other contact with buildings or building materials between 2012 and 2014. These types of injuries are most commonly seen at construction sites and industrial worksites.  Ensuring that OSHA standards are adhered to can greatly decrease these types of injuries. If you see a dangerous situation at your worksite, report it immediately. If someone is injured or killed as a result of unsafe conditions, the owner of that property or business can be held liable.

Motor Vehicle Accidents

Not an hour goes by in New York when we’re not jarred by the shrill sirens of New York’s finest police and firefighters. Most likely, they are responding to a motor vehicle accident, which is the cause of over 106,000 emergency room visits between 2012 and 2014. Motor vehicle accidents take many forms, from autos, motorcycles, busses or big rigs. Injuries arising from motor vehicle accidents can include:

  • Broken bones
  • Bruising
  • Lacerations
  • Paralysis
  • Traumatic brain injury
  • Soft tissue damage
  • Amputations
  • Death
