Wrong-Way Driver Plows into Pedestrians in Times Square

How might the outcome of a DUI case impact your car accident claim?

A shocking accident recently resulted in the death of one pedestrian and injuries to nearly two dozen more in Times Square.  The accident occurred when a wrong-way driver crashed into the bustling heart of Manhattan just before noon on a Thursday.  The driver has been identified as a 26-year-old male driving a Honda Accord.  He is in custody on charges of second-degree murder and 20 counts of attempted murder.  Investigations have revealed this wrong-way driver has a history of arrests for driving while intoxicated.  Police report the driver was tested at the scene for drug or alcohol use, though results have not yet been released.

Drunk Driving and Your Car Accident Claim

With its potential involvement of drugs or alcohol, this recent fatal New York City car accident raises some interesting questions about the impact of drunk driving on your car accident claim.  Driving while intoxicated is patently illegal and highly dangerous.  Driving under the influence of drugs or alcohol renders drivers unable to perceive obstacles ahead, maintain their speed, and stay on the roadway.  If you have been injured in an accident that may have involved a drunk driver, it is important that you take swift action to preserve your legal claim.

It is critical that you contact law enforcement officers right away after the accident so that the possibility of drug or alcohol use can be investigated.  If prompt investigations are not initiated, evidence of intoxication could be permanently lost.  Drugs are notoriously hard to detect in some drivers, so police need to consider an array of potential illegal substances when the driver’s behavior so warrants.  Drivers that test positive for drugs or alcohol will likely be charged with driving under the influence.

While criminal charges are separate and distinct from your civil car accident claim, the outcome of a criminal case can influence your civil case.  You will have a strong case against the driver that hit you if he or she has been convicted of a DUI.  These cases could even lead to the award of punitive damages for the accident victim.  Contact a car accident lawyer for individualized assistance with your drunk driving-related car accident.
